Terms of Service

Welcome to jewl(formerly flanl) (“jewl,” “we,” “us,” or “our”), a jewelry and watch collection, portfolio, and social app for iOS, built and operated by an independent developer (the “Service”). These Terms of Service (the “Terms”) govern your use of the Service. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that any registration information you provide is accurate.

2. The Service

The Service lets you catalog jewelry and watches you own, view automated estimates of what your pieces may be worth, and share pieces with friends. Collections are friends-only by default, with per-piece visibility controls, and financial values are visible only to you.

3. Valuations are estimates — not appraisals or advice

All values shown in the Service are automated estimates provided for your personal, informational use only. They are generated from public marketplace listing data and precious-metal spot prices, and they are not appraisals, not offers to buy or sell, and not financial, investment, insurance, or tax advice. We do not guarantee the accuracy, completeness, or timeliness of any estimate, and actual market prices may differ significantly. Do not rely on the Service for any financial decision — consult a qualified professional appraiser or advisor for decisions about buying, selling, insuring, or valuing your pieces.

4. Your content and license to us

You own your content.Photos, piece details, and other material you add to the Service (“User Content”) remain yours. So that we can operate the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your User Content solely to provide the Service and only in accordance with your visibility settings (for example, showing a friends-visible piece to your friends). This license ends when you delete the content or your account, except for limited residual backup copies while they expire. You represent that you have the rights to the content you post and that it does not violate these Terms or any law.

5. Acceptable use — zero tolerance for objectionable content

We have zero tolerance for objectionable content and abusive behavior. You agree not to post, share, or engage in:

  • Harassment or bullying of any person, or threats of violence.
  • Hate speech or content that demeans people based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic.
  • Nudity or sexual content of any kind.
  • Spam, scams, deceptive practices, or unauthorized commercial solicitation.
  • Impersonation of any person or entity, or misrepresentation of your affiliation with anyone.
  • Promoting counterfeit goods — including passing off replica or counterfeit jewelry or watches as genuine.
  • Illegal content or content that facilitates illegal activity, including the sale of stolen goods.
  • Attempts to interfere with the Service, access other users’ accounts or non-public data, or circumvent security or visibility controls.

6. Moderation, reporting, and blocking

The Service includes tools to keep the community safe: you can report objectionable content and block other users directly in the app. We review reports within 24 hours, remove content that violates these Terms, and may suspend or terminate the accounts of users responsible for it. 7. Termination

You may stop using the Service at any time and may delete your account in the app (Settings), which deletes the account and its content. We may suspend or terminate your access to the Service at any time — including for violations of these Terms, to comply with law, or to protect the Service or its users. Sections of these Terms that by their nature should survive termination (such as the disclaimers, limitation of liability, and governing law) will survive.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY VALUE ESTIMATE IS ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE — INCLUDING ANY RELIANCE ON VALUE ESTIMATES — WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS (US$100).

10. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Nothing in these Terms limits any non-waivable rights you have under the consumer-protection laws of the place where you live.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version here with a new “Last updated” date, and where a change is material we will provide notice in the app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
